2. Platform Usage
Users must use our platform strictly for legal business purposes. Selling prohibited products, providing false information, or engaging in fraudulent activity is strictly forbidden. Our team reserves the right to suspend or terminate any account if misuse is detected.
3. Payments & Transactions
- All payments must be processed through our authorized secure payment gateways.
- Transactions are completed based on the information provided by the user.
- Users are solely responsible for any fraudulent or illegal transactions made through their account.
4. Privacy
Your personal information will be stored with the highest level of security. We will not share your data with third parties unless required by law.
5. Account Termination
Any violation of these terms may result in account termination without prior notice. Users may also request account closure at any time by contacting our support team.
6. Merchant & Content Responsibility
- Merchants are solely responsible for all products, product images, descriptions, pricing, and other content they upload or list on their storefront.
- Sellsull does not review, verify, or endorse third-party product listings and is not the seller of record for any merchant's products — the sales contract is between the merchant and their customer.
- Merchants must own or hold valid rights/licenses to use any trademarks, brand names, logos, product images, and descriptions they upload, and must not infringe upon any third party's intellectual property rights.
- Merchants are solely responsible for the legality of the products they sell, the accuracy of their listings, and any transactions or disputes arising from sales made through their store.
7. Copyright & Trademark Infringement (IP Takedown) Policy
Sellsull respects the intellectual property rights of others and expects every merchant on our platform to do the same. If you believe that a product listing, image, brand name, or other content on any Sellsull-powered storefront infringes your copyright, trademark, or other intellectual property rights, please submit a written complaint to our designated IP contact at [email protected] (or via Contact Us).
7.1 How to Submit a Complaint
Your complaint should include:
- Identification of the copyrighted work or registered/common-law trademark you claim is being infringed.
- The specific storefront/product URL(s) where the alleged infringing content appears.
- Your name, contact details, and your relationship to the rights holder (owner, licensee, or authorized agent).
- A statement of your good-faith belief that the use is not authorized by the rights holder, its agent, or the law.
- A statement, made under penalty of perjury, that the above information is accurate and that you are authorized to act on behalf of the rights holder.
- A physical or electronic signature of the rights holder or person authorized to act on their behalf.
Upon receiving a complete and valid complaint, Sellsull will review it and may remove or disable access to the reported listing/content and notify the merchant involved, at its sole discretion. Sellsull reserves the right to request additional information or reject any complaint it deems invalid or insufficient, and is not obligated to make a legal determination of infringement before acting.
7.2 Counter-Notification
If a merchant believes their listing or content was removed or disabled as a result of mistake or misidentification, they may submit a counter-notification to [email protected] identifying the removed content, explaining the basis for their good-faith belief that the removal was in error, and providing their contact information and consent to the jurisdiction of the courts in their location. Sellsull will review counter-notifications and may reinstate the content if the complaint is not further pursued or is found to be invalid.
7.3 Repeat Infringers
Sellsull may, in its sole discretion, suspend or permanently terminate the account of any merchant who is found to be a repeat infringer of third-party intellectual property rights.
8. Limitation of Liability
The platform, its services, and tools are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or completely secure at all times.
To the maximum extent permitted by applicable law, Sellsull and its team shall not be liable for any indirect, incidental, special, or consequential damages — including but not limited to loss of sales, revenue, profits, data, or business opportunity — arising from service downtime, technical errors, third-party payment/courier/advertising integrations, or any other use of the platform. Where liability cannot be excluded under applicable law, Sellsull's total liability for any claim arising out of or relating to these terms or the services shall not exceed the amount paid by the user to Sellsull for the service in question during the three (3) months preceding the event giving rise to the claim.
9. Governing Law & Jurisdiction
These terms and any dispute arising out of or in connection with them or the use of the platform shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to its conflict-of-law principles. Both parties agree to submit to the exclusive jurisdiction of the courts of Dhaka, Bangladesh, for the resolution of any such dispute.
